TAKE NOTICE†† that on May 8, 2001 the Board received an application from Newfoundland Power Inc. (the ďApplicantĒ) requesting an order of the Board pursuant to Sections 41 and 53 of the Public Utilities Act for approval of:

 


1.                the Support Structures Purchase Agreement with Aliant Telecom Inc. (ďAliantĒ) comprising of a total aggregate purchase price of $45,858,000, with payment of$22,929,000 in 2001 and the remainder to be paid in annual instalments to January 1, 2005;

 

2.                the Facilities Partnership Agreement, effective as of January 1, 2001, governing Aliantís use of all support structures in the Applicantís service territory, including the payment of remuneration by Aliant to the Applicant in connection with Aliantís use of support structures and payment of contributions with respect to the construction of certain support structures;

 

3.                the supplementary capital expenditures for 2001 in the amount of $26,245,000, consisting of $22,929,000 to be paid to Aliant in 2001 and $3,316,000 for distribution plant additions in 2001; and

 

4.                other such matters as may appear just and reasonable upon the hearing of this application.

 

 

AND TAKE NOTICE that any or all customers of the Applicant may be affected by the proposed application.

 

AND FURTHER TAKE NOTICE the Board has determined that it will hold a hearing into the matter, which shall begin at 9:30 a.m. on Thursday, June 7, 2001 in the Boardís Hearing Room, 2nd Floor, Prince Charles Building, 120 Torbay Road, St. Johnís, NF.

 

HOW TO SEE THE APPLICATION:

Copies of the Application are available to the public by contacting the Board between the hours of 8:30 a.m.- 12:30 p.m. and 1:30 p.m. - 4:30 p.m. at the offices of the Board or upon request from the Board Secretary by telephone at (709) 726-8600.

 

The Application can also be viewed at the Applicantís regional offices throughout the Province.

 

HOW TO PARTICIPATE:

The Board will follow the procedures as set out in Newfoundland Regulation 39/96 (ďthe RegulationsĒ) with respect to filing of evidence, requests for information, and other matters relating to the hearing.

 

Any person wishing to be made a party to the hearing must apply by way of an Intervenor=s Submission with the Board, as set out in section 9 of the Regulations.This submission should concisely state the interest such person has in the Application, the facts and reasons which will be entered as evidence (together with any supporting documentation) and the disposition of the proceedings which the Intervenor advocates.

 

Any interested person who does not wish to intervene in respect of the proceeding and thus not be considered a party, but who wishes to communicate their views to the Board, may file a Letter of Comment.The Letter of Comment must state the nature of the personís interest in the proceeding and the personís views regarding the proceeding, together with any relevant information that may be useful in explaining or supporting those views.
